Poland Introduces Stricter Work‑Authorization Rules for Non‑EU Students

Non-EU Student Work Authorization
Poland is preparing for a significant shift in how non‑EU students access the labor market. The long‑standing rule that allowed any full‑time foreign student to work without a permit will no longer apply.
Beginning 1 July 2026, only students who enroll full‑time at institutions approved by the Ministry of Interior and Administration (MSWiA)—or at institutions that are legally exempt from approval, such as public universities—will retain the right to work without a permit. Students attending schools that have not completed the MSWiA approval process will lose access to this exemption after 30 June 2026.
Verifying an Institution’s Status
To confirm eligibility, employers should verify that a student’s institution qualifies for the work‑permit exemption before hiring. Current government guidance highlights three key checks:
- The Ministry of Interior and Administration maintains the MSWiA Main Register, the only complete list of institutions authorized to enroll foreign students. It updates the register regularly on gov.pl, and employers should treat it as the primary reference.
- Avoid partial “short lists”: Year‑specific announcements often rank high in search results but only show institutions added that year, not the full approved list.
- Check for exempt institutions: Public universities, military academies and church‑run schools do not require MSWiA approval. Their status can be confirmed through the RAD‑on system.
