Zambia Enacts New Immigration Control Act to Replace 2010 Law

  • Zambia has implemented the Immigration Control Act, 2026, introducing a modernized immigration framework and formally repealing the Immigration and Deportation Act of 2010.

Immigration Control Act 

Zambia enacted the Immigration Control Act, 2026 (Act No. 3 of 2026), which was assented to on March 31, 2026 and published on April 8, 2026.  

The new legislation updates the rules governing the entry, stay and departure of foreign nationals and repeals and replaces the Immigration and Deportation Act, Cap. 123 (2010). 

Updated Permit Categories 

The Act introduces a comprehensive and modernized suite of immigration permits. These include: 

  • Residence Permit 
  • Employment Permit  
  • Business Permit and Investor’s Permit 
  • Spouse Permit and Dependent Permit 
  • Study Permit, Visiting Permit and Transit Permit 
  • Temporary Employment Permit and Seasonal Employment Permit 

These categories expand and clarify the types of authorization available to foreign nationals residing or working in Zambia. 

Revised Entry and Exit Requirements 

The Act updates the rules governing the entry and departure of foreign nationals. Key changes include: 

  • Entry permitted only through designated ports of entry 
  • Updated visa application and adjudication procedures 
  • New requirements for the examination of entrants upon arrival 
  • Expanded obligations for carriers transporting passengers into or out of Zambia 

Compliance and Enforcement 

The Act strengthens compliance mechanisms and enforcement authority. Notable areas include: 

  • Updated definitions and procedures for prohibited and illegal immigrants 
  • Revised deportation and removal processes 
  • New obligations for employers, educational institutions and accommodation providers 
  • Expanded penalties, offenses and appeals procedures 

These measures aim to improve regulatory oversight and ensure adherence to immigration laws.
