USCIS Extends Certain TPS-Based EADs for Ukraine Beneficiaries

  • USCIS announced that certain Ukraine Temporary Protected Status beneficiaries with pending Employment Authorization Document (EAD) renewal applications will receive an automatic extension of their expired TPS-based EADs through October 19, 2026.  

TPS-Based EADs for Ukraine Beneficiaries 

On August 14, 2026, U.S. Citizenship and Immigration Services (USCIS) announced additional guidance for Ukraine Temporary Protected Status (TPS) beneficiaries whose Employment Authorization Document (EAD) renewal applications remain pending. USCIS will issue notices extending certain expired TPS-based EADs through October 19, 2026, the current end date of Ukraine’s TPS designation.  

According to USCIS, the TPS designation for Ukraine and related benefits are scheduled to terminate on October 19, 2026. The agency is providing temporary employment authorization relief for eligible individuals who have not yet received renewed EADs.  

Impacted Individuals

USCIS will send notices to Ukraine TPS beneficiaries who: 

  • Remain eligible for TPS; 
  • Have a pending TPS-based EAD renewal application; 
  • Have not yet received a renewed EAD with category codes A-12 or C-19.

Individuals will receive the notices by mail and electronically if they have a myUSCIS account.  

Employment Authorization and Form I-9 Guidance 

Employees who receive the USCIS notice may present the following documents as evidence of identity and employment authorization for Form I-9 purposes through October 19, 2026:

  • An EAD with an expiration date of October 19, 2023, or April 19, 2025; and
  • USCIS notice extending the EAD’s validity.

USCIS instructed employers to record October 19, 2026, as the expiration date in the applicable Form I-9 fields and to note the extension in the Additional Information section. Employers may also retain supporting USCIS documentation with the Form I-9 record.

For E-Verify cases, employers should use October 19, 2026, as the document expiration date.

What’s Next? 

Ukraine’s TPS designation and related benefits are currently scheduled to end on October 19, 2026. USCIS advises beneficiaries and employers to monitor agency announcements for additional updates regarding Ukraine TPS and employment authorization documentation.
