DHS Termination Actions and EAD Extensions for Several TPS Designations

Termination Stayed; EADs Automatically Extended 

The Department of Homeland Security (DHS) has released a consolidated set of Temporary Protected Status (TPS) termination updates affecting Ethiopia, South Sudan, Syria, Burma (Myanmar), Somalia, Haiti and Yemen.

All six updates include automatic Employment Authorization Document (EAD) extensions, and Ethiopia additionally benefits from a federal court stay that pauses termination while litigation continues.

Outcome

  • EADs for all six TPS designations receive automatic extensions per DHS guidance.
  • Ethiopia:
    • A federal court stay halts termination.
    • EADs expiring June 12, 2024 or December 12, 2025, are automatically extended to July 17, 2026.
  • Haiti, South Sudan, Syria, Burma/Myanmar, Somalia, Yemen:
    • DHS confirms automatic EAD extensions tied to each termination timeline.
    • Employers must use DHS‑listed extended dates and annotate Form I‑9 accordingly.
  • Employers must ensure correct category codes (A12 or C19) and follow DHS‑specified documentation rules for Form I‑9 and E‑Verify.

The following TPS designations are covered under the DHS/USCIS automatic EAD extensions, with eligibility determined by the original EAD expiration dates listed below.

Burma (Myanmar) — Extended to July 17, 2026

November 25, 2025; May 25, 2024; November 25, 2022

Ethiopia — Extended to July 17, 2026

June 12, 2024; December 12, 2025

Haiti — Extended to July 24, 2026

February 3, 2026; August 3, 2025; August 3, 2024; June 30, 2024; February 3, 2023; December 31, 2022; October 4, 2021; January 4, 2021; January 2, 2020; July 22, 2019; January 22, 2018; July 22, 2017

Somalia — Extended to July 17, 2026

March 17, 2023; September 17, 2024; March 17, 2026

South Sudan — Extended to July 17, 2026

November 3, 2023; May 3, 2025; November 3, 2025

Syria — Extended to July 17, 2026
