Ontario, Canada Finalizes New Job Posting Requirements

Job Posting Requirements
Ontario has finalized Ontario Regulation 476/24, which establishes new requirements for publicly advertised job postings under the Employment Standards Act, 2000. The rules apply to employers with 25 or more employees and take effect on January 1, 2026, aligning with amendments introduced through the Working for Workers Four Act, 2024, and the Working for Workers Five Act, 2024.
The regulation requires employers to include expected compensation in all publicly advertised job postings and limits salary ranges to $50,000 unless the role pays more than $200,000. It also defines “artificial intelligence” and requires employers to disclose when they use AI to screen, assess or select applicants.
Employers must also indicate whether the posting is for a vacant position and notify any interviewed applicant of the hiring decision within 45 days of the final interview. Notifications may be provided in person, in writing or any electronic communication method.
The regulation further requires employers to maintain copies of job postings, applications received and applicant notifications for three years to meet ESA record‑keeping obligations.
