New Executive Order Directs Agencies to Strengthen Enforcement Against Birth Tourism

• President Donald Trump signed an Executive Order directing federal agencies to implement new measures aimed at preventing foreign nationals from using nonimmigrant visas to travel to the U.S. for the purpose of giving birth and obtaining immigration-related benefits for their children. 

Trump Executive Order on Birth Tourism 

On August 6, 2026, President Donald Trump signed Executive Order 14419, “Ending Birth Tourism,” establishing a new federal policy aimed at preventing foreign nationals from traveling to the U.S. on temporary visas to give birth and obtain U.S. citizenship-related benefits for their children.  

The Executive Order was published in the Federal Register on August 11, 2026.  

The Administration states that birth tourism undermines the integrity of the U.S. immigration system and enables foreign nationals to exploit nonimmigrant visa categories that were created for temporary travel, study, work or other authorized activities.  

How the Executive Order Defines Birth Tourism 

The Executive Order defines “birth tourism” as: 

• A foreign national entering the U.S. on a nonimmigrant visa for the purpose of giving birth on U.S. soil; or 
• Any effort to facilitate the entry of a foreign national into the U.S. on a nonimmigrant visa for that purpose.  

Key Immigration Enforcement Measures 

The Executive Order delegates authority to the Departments of State and Homeland Security to implement policies and guidance necessary to enforce the new restrictions. Potential actions include:  

• Denial of visas or travel authorizations for individuals seeking to engage in birth tourism.  
• Revocation of visas or travel authorizations and permanent entry bars for individuals who enter or attempt to enter the U.S. for birth tourism purposes.  
• Denial of admission or removal of foreign nationals who have previously engaged in or plan to engage in birth tourism.  
• Enforcement actions against organizations, businesses or individuals that facilitate or enable birth tourism activities.  

What’s Next? 

The Departments of State and Homeland Security will release additional guidance, policies and operational procedures to support implementation of the Executive Order.
