Germany Extends Temporary Residence Measures for Certain Ukrainian Nationals

  • Germany has extended key provisions under its Ukraine Residence Transition Regulation through 2027 while introducing new requirements for certain Ukrainian nationals subject to military service obligations.

Overview

The German government published the Ninth Regulation Amending the Ukraine Residence Transition Regulation on Oct. 8, 2026, extending several temporary residence measures for eligible Ukrainian nationals. The regulation was adopted on Spt. 30, 2026 and enters into force the day after publication.

Extension of Residence Provisions Through December 2027

Germany has extended the validity of certain protections and residence-related provisions under the Ukraine Residence Transition Regulation by one year.

Specifically, references to Dec. 4, 2026 have been replaced with Dec. 4, 2027, extending the applicability of relevant measures through that date.

New Restriction for Certain Ukrainian Nationals

The amendment introduces a new provision affecting foreign nationals who:

  • Enter Germany on or after Oct. 9, 2026; and
  • Are subject to military service obligations under Ukrainian law.

Under the new rule, the extended residence provisions generally will not apply to these individuals unless they can demonstrate compliance with their military obligations in Ukraine.

Additional Extension to March 2028

The regulation also amends another provision of the Ukraine Residence Transition Regulation, replacing the date March 4, 2027, with 4 March 4, 2028, thereby extending related transitional measures for an additional year.

What Employers Should Know

Employers with Ukrainian national employees in Germany may benefit from the continued availability of temporary residence measures through 2027 and 2028, depending on the applicable provision. However, organizations that sponsor or hire Ukrainian nationals who enter Germany on or after Oct. 9, 2026, should be aware of the new requirements regarding Ukrainian military service obligations and assess whether additional documentation may be required. Also, with the extension through 4 March 2028, Ukrainian citizens with temporary protection status do not need to apply for an additional extension; the extension is granted by law.

Was Arbeitgeber wissen sollten
