India EB-5 Unreserved Visa Cap Reached for FY 2026

  • The U.S. Department of State confirmed that EB-5 unreserved visas for Indian nationals are fully allocated for FY 2026, pausing further issuance until the next fiscal year.

EB-5 Unreserved Visa Cap Reached for FY 2026 

The Department of State announced that India reached its per-country limit in the EB-5 unreserved category for FY 2026. The Department will not issue additional EB-5 unreserved visas to Indian applicants for the remainder of the fiscal year.

As a result, U.S. consulates and embassies will pause issuance of EB-5 unreserved visas for Indian nationals until visa numbers reset at the start of FY 2027 on October 1, 2026.

The EB-5 Immigrant Investor Program remains subject to annual numerical limits and per-country caps, which continue to impact high-demand countries like India and contribute to processing delays.

What this means: 

  • Indian EB-5 unreserved applicants should expect delayed visa issuance timelines
  • The State Department will resume visa availability in FY 2027
  • Continued high demand may lead to future backlogs and longer wait times
