Federal Court Blocks DHS From Ending TPS for Yemen

Court Decision for TPS for Yemen

A federal judge in the Southern District of New York has temporarily halted the termination of Temporary Protected Status (TPS) for Yemen, which had been scheduled to end on May 4, 2026. The ruling allows more than 3,200 Yemeni nationals with TPS or pending applications to remain in the U.S. and continue working while litigation proceeds.

  • The court found that DHS may not have followed required procedures before ending TPS for Yemen and therefore postponed the effective termination date. 
  • Yemen has held TPS since 2015 due to ongoing armed conflict and severe humanitarian conditions, and the court noted that these conditions continue to prevent safe return. 
  • The decision protects thousands of longterm U.S. residents, including individuals working in healthcare, research, transportation and the small-business sector.
