DHS Terminates Temporary Protected Status (TPS) for Yemen
Key Point
- The Department of Homeland Security announced that Temporary Protected Status for Yemen will end on May 4, 2026, after determining the country no longer meets the statutory requirements for the designation.
TPS for Yemen
The Department of Homeland Security (DHS) has announced the termination of Temporary Protected Status (TPS) for Yemen, following a review of current country conditions and consultation with relevant U.S. government agencies. According to DHS, Yemen no longer meets the statutory requirements for TPS designation.
Effective Date
Yemen’s TPS designation will officially end on May 4, 2026, which is 60 days after publication of the Federal Register notice.
Background
Yemen was first designated for TPS in September 2015 due to ongoing armed conflict and severe humanitarian conditions. The designation has been extended multiple times over the past decade. DHS announced its decision to terminate TPS for Yemen on Feb. 13, 2026.
Impact on Current TPS Beneficiaries
Once the termination takes effect:
- Yemeni nationals who hold TPS and do not have another lawful immigration status will no longer be protected from removal.
- Individuals will be expected to depart the U.S. unless they obtain another form of lawful status.
- DHS notes that individuals may use the CBP Home app to report voluntary departure once their TPS ends.
Employment Authorization
Employment authorization based on TPS remains valid through the 60‑day transition period. After the effective termination date, work authorization tied to TPS will no longer be valid unless the individual has another basis for employment eligibility.
Next Steps
The forthcoming Federal Register notice will include:
- The official termination date
- Instructions for TPS beneficiaries
- Information on employment authorization and departure procedures
