Australia Enacts New Law Allowing Temporary Restrictions on Certain Visa Holder Arrivals

Key Point

  • Australia has passed the Migration Amendment Act, giving the government new authority to temporarily restrict the arrival of certain temporary visa holders during periods of elevated migration‑related risk.

Temporary Restrictions on Certain Visa Holder Arrivals

Australia has enacted the Migration Amendment (2026 Measures No. 1) Act 2026, a legislative change that gives the government new authority to temporarily restrict the arrival of certain classes of temporary visa holders during periods of elevated migration‑related risk.

New Arrival‑Control Framework

According to the official bill summary published by the Parliament of Australia, the Act amends the Migration Act 1958 to allow the government to:

  • Temporarily limit or block the arrival of specific groups of temporary visa holders
  • Activate restrictions when events or circumstances outside Australia create an increased risk that certain temporary visa holders may not depart when their visas expire

This marks the first time such targeted arrival‑control powers have been formally codified in Australian migration law.
