USCIS Updates Guidance on Termination of TPS for Burma

Key Point  

  • A federal court order has postponed the termination of TPS for Burma/Myanmar, extending certain EADs through July 1, 2026. 

TPS for Burma/Myanmar  

The U.S. Citizenship and Immigration Service (USCIS) issued updated guidance on the termination of Temporary Protected Status (TPS) for Burma/Myanmar, superseding its March 27, 2026, notice.  

Burma/Myanmar’s TPS designation and related benefits formally terminated on January 26, 2026, following a prior determination that the country no longer met the statutory conditions for TPS designation. 

However, a January 23, 2026, federal court order in Aung DOE et al. v. Noem et al. (N.D. Ill.) postponed the effective termination date, resulting in the continued validity of certain TPSrelated documents. 

Employment Authorization Documents (EADs) 

Per the federal court order, USCIS confirms that EADs issued under the TPS designation for Burma with the following original expiration dates remain valid: 

  • November 25, 2025 
  • May 25, 2024 
  • November 25, 2022 

These EADs are automatically extended through July 1, 2026 

Form I9 and EVerify Guidance 

According to E-Verify guidance, when completing Form I9 for affected employees: 

  • Section 1: Employees should enter “as per court order” in the expiration date field. 
  • Section 2: Employers should enter “July 1, 2026” and note the courtordered extension in the Additional Information box. 
  • Employers may attach the USCIS alert and TPS Burma webpage to the Form I9 as supporting documentation. 

For EVerify: 

  • Use the expiration date “July 1, 2026” from the Form I9.
