USCIS Proposes Changes to Premium Processing Timeframe

  • The U.S. government is reviewing a proposed rule that would amend the premium processing timeframe for certain immigration benefit requests handled by USCIS.

Potential Rule Change to Premium Processing Timeframe

A proposed rule titled “Amending the Premium Processing Timeframe” has been submitted for regulatory review and is currently listed as a pending action under the federal rulemaking process on Oct. 13, 2026.

Few details about the proposal are currently available. However, the rule is undergoing review under Executive Order 12866 Regulatory Review and is not classified as economically significant.

Looking Ahead

At this stage, the regulatory listing indicates that there is no statutory legal deadline associated with the proposed action. The proposal is currently undergoing regulatory review under Executive Order 12866, which is one of the steps in the federal rulemaking process. If the proposal moves forward, USCIS may publish a proposed rule that provides additional details on the contemplated changes, the rationale behind them and any proposed implementation timeline. Stakeholders can expect more information once the agency releases the proposed rule for public review.

About Premium Processing Currently

Premium processing is an optional expedited service offered by USCIS for certain immigration benefit requests. Employers and foreign nationals who use premium processing receive expedited adjudication in exchange for an additional filing fee. USCIS guarantees action on an eligible filing within a specified processing timeframe that varies by form category.
