USCIS Issues New Guidance on Ukraine TPS and Employment Authorization for October 2026

USCIS announced that Ukraine’s Temporary Protected Status (TPS) designation and related benefits are currently set to expire on Oct. 19, 2026, while certain eligible beneficiaries will receive automatic Employment Authorization Document (EAD) extensions through that date.

USCIS Provides New Ukraine TPS Guidance

U.S. Citizenship and Immigration Services (USCIS) has released updated guidance for beneficiaries of (TPS) under Ukraine’s designation. According to USCIS, Ukraine’s TPS designation and related benefits are currently set to terminate on Oct. 19, 2026.

The agency is sending notices to certain Ukraine TPS beneficiaries confirming that their TPS-based work authorization has been automatically extended through the end of the current designation period.

Automatic Ukraine TPS Work Authorization Extension

USCIS is providing automatic EAD extensions to certain individuals who:

  • Previously filed an Application for Employment Authorization under Ukraine TPS;
  • Continue to be eligible for TPS;
  • Hold TPS-based EADs with category codes A12 or C19; and
  • Possess EADs that expire before Oct. 19, 2026.

Affected beneficiaries will receive notices from USCIS confirming that their employment authorization remains valid through Oct. 19, 2026.

Ukraine TPS Background

Ukraine remains one of the countries currently designated for TPS. USCIS lists the current TPS designation period as running through Oct. 19, 2026. Eligible individuals must have continuously resided in the U.S. since Aug. 16, 2023, and been continuously physically present in the U.S. since Oct. 20, 2023, to qualify under the current designation.

Employer Considerations

Employers with workers relying on Ukraine TPS should:

  • Review upcoming employment authorization expiration dates.
  • Confirm whether affected employees have received USCIS extension notices.
  • Update Form I-9 records as permitted under USCIS guidance.
  • Monitor future DHS and USCIS announcements regarding the future of Ukraine TPS beyond Oct. 19, 2026.

What’s Next?

At this time, USCIS states that Ukraine TPS and related benefits are set to expire on Oct. 19, 2026, unless further government action is taken. The agency has encouraged beneficiaries and employers to continue monitoring the USCIS Ukraine TPS webpage for additional updates.
