United Kingdom Announces Immigration Rule Changes Effective October 2026

  • The United Kingdom will implement several changes to the Immigration Rules on Oct. 8, 2026, affecting Skilled Workers, visitors, EU Settlement Scheme applicants, Hong Kong BN(O) migrants, and domestic abuse routes.  

Immigration Rule Changes Fall 2026 

The United Kingdom Home Office published Statement of Changes to the Immigration Rules: HC 584, introducing a range of amendments that take effect on Oct. 8, 2026.  

The changes affect multiple immigration categories, including the Skilled Worker route, the EU Settlement Scheme (EUSS), the Visitor route, the Hong Kong BN(O) route and the Victim of Domestic Abuse route.  

Fee Waiver Applications and Biometrics 

Applicants who submit an immigration fee waiver request and later make a variation application must still provide biometrics within the deadline associated with the original application. The rules also clarify when an application date is preserved following a fee waiver request. 

Skilled Workers Who Are Victims of Modern Slavery 

A new provision allows certain Skilled Workers who receive a positive Conclusive Grounds decision through the UK’s modern slavery framework to qualify for broader work permissions, subject to applicable eligibility requirements and restrictions. 

Visitor Route Changes 

The rules expand permitted visitor activities by: 

  • Allowing attendance at workshops and debates. 
  • Permitting participation in skills competitions. 
  • Allowing entertainment staff supporting artists, musicians and performers to undertake certain activities. 
  • Introducing new provisions for participants in the Erasmus+ program, including training, traineeships, job shadowing and coaching assignments.  

EU Settlement Scheme Updates

The government has made a series of technical amendments to the EU Settlement Scheme, including changes affecting derivative rights of residence, joining family members and application timing requirements. 

Hong Kong BN(O) Settlement Changes 

The rules amend settlement requirements for applicants on the Hong Kong BN(O) route. Most applicants will need five years of continuous residence on a settlement route, although the five-year requirement will not apply to applicants under age 18.  

Victim of Domestic Abuse Route 

Changes clarify eligibility for the Victim of Domestic Abuse route, including expanded provisions covering certain children and individuals with status under the EU Settlement Scheme. The amendments also clarify eligibility for applicants abandoned overseas. 

Suitability Requirements 

The suitability provisions are amended to clarify that an applicant may be refused where they have acted to frustrate immigration controls.
