U.S. Diversity Visa Lottery 2027 Program Remains Suspended After Appeals Court Stay

  • A U.S. federal appeals court has paused a lower court order requiring the U.S. Department of State to reopen registration for the FY 2027 Diversity Visa (DV) Lottery program, leaving the program’s status uncertain.

Appeals Court Halts Order to Reopen DV-2027 Lottery

The U.S. Court of Appeals for the Ninth Circuit has granted the U.S. Department of State’s request to stay a preliminary injunction that would have required the government to reopen the FY 2027 Diversity Visa (DV) Lottery registration process.

The ruling follows a lawsuit filed by an immigration law firm that challenged the government’s decision not to launch the DV-2027 registration period. The Department had not opened the lottery registration window as expected, effectively suspending the FY 2027 Diversity Visa program.

Diversity Visa Lottery 2027: What Happened?

Under U.S. law, the Diversity Visa Program must make up to 55,000 immigrant visas available annually to individuals from countries with historically low rates of immigration to the United States. Normally, the U.S. Department of State conducts a lottery and selects approximately 100,000 individuals who may then apply for a diversity visa.

According to the court order:

  • The Department did not open the FY 2027 DV Lottery registration period.
  • A federal district court ordered the government to reopen the program and publish a registration timeline.
  • The government appealed that decision and sought an emergency stay.
  • The Ninth Circuit granted the stay while the appeal proceeds.

Why the Appeals Court Granted the Stay

The Ninth Circuit found that Red Eagle Law, L.C. was unlikely to succeed on the merits because the firm may not have legal standing to challenge the suspension of the Diversity Visa Program. The court concluded that the program was designed to promote immigration diversity, not to protect the business interests of immigration law firms.

The court emphasized that it was not endorsing the Department’s failure to open the DV-2027 lottery but determined that the plaintiff had not established an appropriate legal basis to bring the claim.

Employer and Applicant Impact

At this time:

  • The FY 2027 Diversity Visa Lottery registration period remains closed.
  • No new registration timeline has been announced.
  • The underlying appeal remains pending before the Ninth Circuit.
  • Prospective applicants should monitor future announcements from the U.S. Department of State regarding the DV-2027 program.
