South Africa Seeks Public Input on Employment Services Amendment Bill
- South Africa has opened public consultation on the Employment Services Amendment Bill, which would introduce new requirements for hiring foreign nationals, allow foreign worker quotas and strengthen labor market enforcement.
Employment Services Amendment Bill
South Africa’s Portfolio Committee on Employment and Labour invited public comments on the Employment Services Amendment Bill.
The proposal would significantly reshape the country’s labor migration framework and regulation of foreign workers. Public comments are being accepted through Nov. 6, 2026.
Key Proposed Changes
The bill would introduce a new framework governing the employment of foreign nationals in South Africa, including:
- Requiring employers to verify that foreign nationals are authorized to work in South Africa.
- Requiring employers to satisfy themselves that suitable local candidates are unavailable before hiring a foreign national.
- Requiring employers to prepare skills transfer plans for positions filled by foreign nationals, unless an exemption applies.
- Requiring foreign nationals to receive terms and conditions that are no less favorable than those offered to South African workers.
Foreign Worker Quotas Proposed
The bill would empower the Minister of Employment and Labour to establish quotas limiting the employment of foreign nationals in specific sectors, occupations or regions after consultation and a public comment process. Small employers would be exempt from quota requirements.
Increased Enforcement and Penalties
The proposal would expand enforcement powers and introduce stricter penalties for non-compliance. Employers that violate provisions related to foreign worker employment could face fines ranging from ZAR 100,000 to as much as ZAR 1 million or 10% of annual turnover for repeated violations.
