Hong Kong Updates Extension‑of‑Stay Rules

  • Hong Kong updated the conditions for permission to stay for foreign nationals under specific visa categories seeking an extension of stay.  

Extension of Stay Permissions  

On April 16, 2026, Hong Kong updated several visa category webpages, including the Immigration Arrangements for Nonlocal Graduates (IANG) and the General Employment Policy (GEP). The updates clarify the timing of extensionofstay applications and reiterate requirements for individuals whose limit of stay is approaching expiry. 

Key Changes 

ExtensionofStay Filing Window  

Both the IANG and GEP pages now confirm that applicants may submit extensionofstay requests within three months of their stay limit expiring. Authorities encourage applicants to apply early, and in all cases at least six weeks before expiry. 

Requirement to Depart Hong Kong if Permission Expires  

The updated guidance also emphasizes that individuals must depart Hong Kong if their stay limit expires before their extension is approved. The webpage notes that, unless exceptional circumstances apply, individuals must leave Hong Kong even if an extension application is pending.  

Overstaying is highlighted as a serious criminal offense. This applies to all persons subject to a limit of stay, including IANG and GEP holders. 

Processing Times 

The Immigration Department indicates that extension applications typically take two to three weeks to process once all required documents and fees are received. Actual timelines may vary based on case specifics and application volume.
