TPS Designation Legal Challenge
On September 5, 2025, the U.S. District Court for the Northern District of California issued a decision invalidating the Department of Homeland Security’s (DHS) actions to terminate Temporary Protected Status (TPS) for Haiti and Venezuela. The court found that DHS failed to follow proper procedures under the Administrative Procedure Act and lacked sufficient legal authority to revoke the designations. Despite the ruling, current TPS protections for nationals of both countries remain in effect, with no immediate changes to eligibility or status. Further legal developments may follow as the case proceeds through appeal.
