DHS Final Rule Updates Alien Registration Requirements and Biometric Compliance

  • The Department of Homeland Security finalized updates to alien registration requirements, including revised forms, evidence of registration and biometric rules, while signaling additional compliance changes ahead. 

DHS Finalizes Alien Registration Rule 

On June 29, 2026, the U.S. Department of Homeland Security (DHS) published a final rule adopting its prior Interim Final Rule (IFR), formalizing requirements for alien registration and fingerprinting. 

 The rule is effective immediately and reflects DHS’s continued effort to standardize registration compliance and vetting processes.  

Updated Registration Forms and Evidence Requirements 

The final rule updates which forms and processes satisfy alien registration requirements, including: 

  • Revisions to approved registration forms and documentation 
  • Updates to what qualifies as evidence of registration, such as Form I-94 and other records 
  • Alignment of form names and classifications with current DHS systems  

Individuals who have not yet registered may continue using Form G-325R (Biographic Information) to meet compliance obligations. 

Changes to Biometric and Fingerprinting Requirements 

DHS introduced targeted updates to biometric requirements, including: 

  • Adjustments to fingerprint waiver provisions 
  • Clarification of prior fingerprinting standards 
  • Broader alignment toward consistent screening and vetting practices across foreign nationals 

Additional Rule Changes Under Consideration 

DHS is seeking public comments on potential future updates, including: 

  • Expanding which forms qualify as registration or proof of registration 
  • Revising biometric collection and waiver policies 
  • Ensuring all individuals meet a uniform vetting baseline 
  • Potential updates to documentation processes and permanent resident requirements  

Public comments are due by August 28, 2026. 

Background 

Alien registration requirements have long existed under U.S. immigration law; however, DHS has recently taken steps to modernize and standardize compliance.  

A March 2025 Interim Final Rule introduced a new general registration form and expanded biometric requirements, aiming to create a more uniform registration and vetting framework across foreign nationals.  

The June 2026 final rule builds on these efforts by formalizing those changes and refining documentation and process requirements.
