USCIS Reaches H-2B Cap for First Half of Fiscal Year 2026

  • USCIS has reached the H-2B visa cap for jobs starting before April 1, 2026 

H-2B Visa Cap Reached 

U.S. Citizenship and Immigration Services (USCIS) has received enough petitions to meet the congressionally mandated H-2B visa cap for the first half of fiscal year 2026. The final date for accepting new cap-subject petitions with employment start dates before April 1, 2026, was September 12, 2025.  

Petitions received after this date will be rejected unless they are exempt from the cap, such as those for returning workers or certain other qualifying categories. Employers seeking H-2B workers for the second half of the fiscal year may still apply when that filing window opens.
