Argentina Overhauls Immigration Policy with Decree 366/2025

Key Points

  • Argentina tightens residency and citizenship rules, restricts public services for non-residents, expands deportation authority and enforces stricter corporate immigration regulations

Key Changes in Argentina’s Immigration Policy

Argentina announced the overhaul of its immigration system through Decree 366/2025. The decree tightens residency and citizenship criteria, restricts non-residents’ access to public services and expands deportation authority. Key changes include the following:

  • Stricter deportation and entry rules: Authorities can more easily remove foreign nationals with criminal records or unlawful residency. Entry may also be denied for false information, undisclosed convictions or lack of a legitimate travel purpose.
  • Tougher citizenship and residency requirements: Naturalization has become more stringent, and permanent residency applications now face increased scrutiny, requiring stronger financial and legal documentation.
  • Restricted access to public services: Nonresidents, including expatriate workers, may face limitations on healthcare and education, requiring private coverage.
  • Work limitations for visitors and business travelers: Individuals entering Argentina for tourism or business cannot engage in paid work without explicit authorization.
  • Updated family reunification rules: Eligible applicants (spouses, parents and children of Argentine citizens or residents) will receive temporary residence for up to three years instead of direct status equivalency.
  • Corporate immigration impacts: Companies sponsoring foreign employees for residency face stricter compliance requirements, including proof of financial stability and adherence to local labor laws. Investment-based residency is now subject to additional review.
  • Mandatory affidavit and health insurance: All visitors, including corporate travelers, must declare their purpose of entry and provide proof of medical coverage.

Implementation details are still pending, with updates to follow as regulations take effect.
