USCIS Announces Introduces New Immigration Fees Under H.R. 1

Updated Fee Rules to Impact Immigration Applications Beginning July 2025
U.S. Citizenship and Immigration Services (USCIS) has issued a Federal Register Notice implementing new immigration-related fees mandated by the H.R. 1 Reconciliation Bill. These fees apply to benefit requests postmarked on or after July 22, 2025, and forms submitted without proper payment after August 21, 2025, will be rejected.
Highlights of the New Fee Structure
- Form I-589 (Asylum Application)
- $100 filing fee
- $100 Annual Asylum Fee (AAF) for each year the application remains pending
- Form I-765 (Employment Authorization)
- $550 for initial applications in specified categories (asylum, parolee, TPS)
- $275 for renewals/extensions
- $275 for EADs tied to approved re-parole requests via Form I-131
- Form I-360 (Special Immigrant Juvenile)
- $250 fee
- Form I-821 (Temporary Protected Status)
- Fee increased from $50 to $500
Additional Notes
- USCIS will notify asylum applicants when their AAF is due, including payment instructions and consequences for non-payment.
- Validity periods for EADs have changed:
- Parolees: valid for up to one year or the duration of parole
- TPS holders: valid for up to one year or the duration of TPS status
Fee Payment Guidance
- H.R. 1 fees are in addition to existing USCIS fees under 8 CFR part 106.
- Each fee must be submitted separately.
- Fee waivers may be requested for existing USCIS fees, but H.R. 1 fees cannot be waived or reduced.
Future Fee Announcements Still to Come
The FRN does not cover all the new fees required by H.R. 1. The Department of Homeland Security (DHS) will announce the implementation of additional fees in a future action. Notably, this FRN does not include the associated fee changes for the following forms:
- Form I-131: Application for Travel Documents, Parole Documents, and Arrival/Departure Records
- Form I-102: Application for Replacement/Initial Nonimmigrant Arrival-Departure Document
