South Africa Proposes Immigration Reform in 2026 White Paper

Immigration Framework Modernization 

South Africa’s Department of Home Affairs has published a draft White Paper proposing major reforms to citizenship, immigration and refugee policy, with public comments due by January 31, 2026. The draft White Paper outlines a comprehensive overhaul of South Africa’s migration system, shifting from compliance-driven processes to a strategic, merit-based framework. Key proposals include: 

  • Skilled Worker Visa Consolidation: Critical Skills and General Work visas will merge into a single Skilled Worker Visa, initially employer-sponsored but with a pathway to self-sponsorship for permanent residency. 
  • Points-Based System (PBS): Extended to Permanent Residency and Naturalization, making citizenship merit-based (skills, investment, social contribution) rather than time-based. 
  • Refugee Policy Update: The government abandoned plans to withdraw from the 1951 Refugee Convention. It will now restrict asylum claims under the “First Safe Country” principle.
  • Immigration Practitioners Regulation: Reintroduction of regulation for immigration practitioners, limiting representation to registered professionals and legal practitioners. 
  • Digital & Compliance Measures: 
    • New Remote Work and Start-Up Visas. 
    • Creation of an Intelligent Population Register (IPR) with mandatory biometrics. 
    • Establishment of Specialized Immigration Courts to fast-track appeals and deportations.

Stakeholders are invited to review the draft White Paper. They should submit comments by 31 January 2026 to help shape South Africa’s future immigration framework.
