H.R. 1 Immigration Fee Adjustments for 2026

Federal Register Notice: H.R. 1 Immigration Fee Adjustments for 2026
On July 22, 2025, the Department of Homeland Security (DHS) published a Federal Register notice implementing inflationary adjustments to select immigration-related fees under H.R. 1. These changes reflect inflation between July 2024 and July 2025 and will take effect on January 1, 2026.
These fees primarily impact certain fees for asylum, parole and Temporary Protected Status (TPS) applications.
Fees Increasing
The following fees will rise slightly:
- Annual Asylum Application Fee: $100 → $102 (currently stayed by court order)
- Form I‑765 (Initial EAD for asylum, parole, TPS): $550 → $560
- Form I‑765 (Renewal/Extension of parole or TPS EAD): $275 → $280
- Form I‑131, Part 9 (Re‑parole EAD): $275 → $280
- Form I‑821 (TPS Application): $500 → $510
Fees Remaining Unchanged
The following fees are not increasing under this notice:
- I‑589 Asylum Fee (Initial filing): $100
- I‑765 Renewal/Extension of Asylum Applicant EAD: $275
- I‑360 Special Immigrant Juvenile Fee: $250
Fee adjustments were originally introduced under the new U.S. immigration budget law, which established inflation‑based changes to certain immigration fees.
Looking Ahead
DHS will continue to publish annual Federal Register notices to reflect inflationary adjustments for applicable fees in future fiscal years.
