Federal Judge Blocks the Birthright Citizenship Order

On July 10, 2025, U.S. District Judge Joseph LaPlante of the New Hampshire federal court temporarily blocked President Trump’s executive order issued on January 1, 2025, which aimed to restrict birthright citizenship across the U.S. The order sought to deny automatic citizenship to children born in the U.S. on or after February 20, 2025, unless at least one parent was a citizen or lawful permanent resident, challenging the long-standing interpretation of the 14th Amendment. The American Civil Liberties Union filed a class-action lawsuit on behalf of pregnant immigrant parents and their infants, prompting the court to grant an injunction.

Supreme Court’s July Ruling

This decision follows the Supreme Court’s July 1 ruling, which limited the scope of nationwide injunctions but left the constitutionality of the executive order unsettled. Implications and Reactions

The ruling temporarily halts the order and gives the government seven days to appeal. The Trump administration has vowed to contest the ruling, describing it as an abuse of judicial power. In contrast, the court emphasized that stripping birthright citizenship would cause “irreparable harm,” referring to citizenship as “the greatest privilege that exists in the world.” While the administration argues the measure reflects the original intent of the 14th Amendment, opponents contend it is unconstitutional and would create a permanent subclass of individuals born in the U.S. without full rights.
