Court Stays Block TPS Terminations for South Sudan, Syria, Ethiopia and Burma

  • Federal courts have issued stays preventing DHS from implementing the termination of TPS for South Sudan, Syria, Ethiopia and Burma, allowing beneficiaries to retain TPS and employment authorization while certain A12 and C19 EADs are automatically extended according to each notice’s instructions. 

TPS Status and EAD Validity 

The U.S. Department of Homeland Security (DHS) previously announced the termination of Temporary Protected Status (TPS) designations for South Sudan, Syria, Ethiopia and Burma. However, federal courts have issued stays in all four cases, temporarily preventing DHS from implementing those terminations. 

As a result, TPS beneficiaries from all four countries will retain their TPS status and employment authorization while litigation continues, and certain Employment Authorization Documents (EADs) remain valid beyond their printed expiration dates. 

Below is a summary of the latest updates for each country. 

What the E‑Verify Notices State 

South Sudan 

  • TPS termination was scheduled for January 5, 2026, but a court‑ordered stay prevents DHS from implementing the termination. 
  • Individuals with TPS from South Sudan retain TPS and employment authorization while the court stay is in effect. 
  • Certain A12 and C19 EADs are automatically extended through the dates listed in the notice. 
  • E‑Verify users should follow the specific reverification instructions provided in the notice. 

Syria 

  • TPS termination was scheduled for November 21, 2025, but a court‑ordered stay prevents DHS from implementing the termination. 
  • Individuals with TPS from Syria retain TPS and employment authorization while the court stay is in effect. 
  • Certain A12 and C19 EADs are automatically extended through the dates listed in the notice. 
  • E‑Verify users should follow the specific reverification instructions provided in the notice. 

Ethiopia 

  • TPS termination was scheduled for February 13, 2026, but a court‑ordered stay prevents DHS from implementing the termination. 
  • Individuals with TPS from Ethiopia retain TPS and employment authorization while the court stay is in effect. 
  • Certain A12 and C19 EADs are automatically extended through the dates listed in the notice. 
  • E‑Verify users should follow the specific reverification instructions provided in the notice. 

Burma (Myanmar) 

  • TPS termination was scheduled for January 26, 2026, but a court‑ordered stay prevents DHS from implementing the termination. 
  • Individuals with TPS from Burma retain TPS and employment authorization while the court stay is in effect. 
  • Certain A12 and C19 EADs are automatically extended through the dates listed in the notice. 
  • E‑Verify users should follow the specific reverification instructions provided in the notice.
