CBP Finalizes Rule Expanding Biometric Collection at U.S. Borders

CBP Final Rule Expands Biometric Collection Nationwide
U.S. Customs and Border Protection (CBP) has finalized a rule expanding its authority to collect biometric data from noncitizens entering and departing the U.S. Effective December 26, 2025, the rule removes previous limitations that restricted biometric exit procedures to pilot programs or specific ports of entry. It authorizes CBP to implement biometric collection nationwide at airports, land ports, seaports and any other authorized departure locations.
Biometric Rule Covers More Noncitizens for Entry-Exit Screening
The rule applies to “non-exempt aliens,” which include:
- Visa holders
- Lawful permanent residents (also known as green card holders)
- Temporary workers
- Children.
CBP may collect facial photographs, fingerprints and other biometric identifiers to verify identity and enhance immigration enforcement. This expansion supports congressional mandates for a comprehensive biometric entry-exit system and updates regulations under 8 CFR Parts 215 and 235.
By formalizing biometric procedures at departure points, CBP aims to improve identity verification, reduce fraud and strengthen border security. The rule also clarifies that biometric collection may occur during both entry and exit, aligning CBP’s operations with the broader goals of the Department of Homeland Security. Travelers subject to biometric collection will be processed using secure, privacy-conscious technologies designed to minimize data retention and misuse.
