On 24 October 2025, Austria approved amendments to the Settlement and Residence Act (NAG) and the Foreign Employment Act (AuslBG), establishing a new residence permit for cross‑border commuters.
The permit allows third‑country nationals who hold permanent residence and full labor market access in a neighboring country to work in Austrian border districts. A prerequisite is a positive report from the Austrian Public Employment Service (AMS) confirming that no suitable candidates are available in Austria for the position.
