Ninth Circuit Court Order Extends 2023 TPS Protections for Venezuela

TPS Venezuela Update
On September 30, 2025, the U.S. District Court for the Northern District of California issued an order setting aside the termination of Venezuela’s 2023 Temporary Protected Status (TPS) designation. As a result, TPS protections under the 2023 designation will remain in effect through October 2, 2026, pending further litigation.
Employment Authorization Document Timeline
EADs issued under the 2023 TPS designation that expire on April 2, 2025, now automatically remain valid through April 2, 2026. Timely renewal applications can extend validity even further—up to 540 days—reaching as late as September 24, 2026.
Beneficiaries who re-registered under the January 17, 2025, Federal Register notice automatically receive extensions on their 2021 TPS-based EADs—regardless of whether those EADs originally expired on September 10, 2025; March 10, 2024; or September 9, 2022. These EADs now remain valid through April 2, 2026. Those who did not re-register will see their EADs expire on November 7, 2025.
