Media Alert: Trump Administration Reviewing All U.S. Visa Holders for Violations

News Reports on Potential Visa Review

Several media outlets—including AP News, Axios and The Washington Post have reported that the Trump administration is conducting a sweeping review of all 55 million foreign nationals holding U.S. visas, aiming to identify any violations that could lead to deportation. The effort includes enhanced vetting measures and data analysis to flag potential threats or infractions, marking a significant expansion of immigration enforcement. 

Attorney Analysis: The Potential Impact 

The full impact of this policy shift on U.S. immigration benefits remains to be seen. However, it is expected that this change may result in heightened scrutiny of filings submitted to U.S. Citizenship and Immigration Services (USCIS), including filings and requests for extensions of immigration benefits. Such scrutiny may manifest in the form of increased issuance of Requests for Evidence (RFEs), Notices of Intent to Deny (NOIDs) or Denials.  

Additionally, this development may lead to a rise in visa application 221(g) Administrative Processing and/or denials at U.S. Consulates, as well as increased worksite enforcement efforts. These may include more frequent site visits conducted by officers from the Department of Homeland Security (DHS) Fraud Detection and National Security (FDNS) unit, along with increased oversight of employment eligibility verification and labor compliance. Specifically, there may be increases in PERM audits, Labor Condition Application (LCA) audits and I-9 inspections initiated by both DHS and the U.S. Department of Labor (DOL).
