EB-3 and EW Visa Caps Reached for FY 2025

Key Point

  • On September 9, 2025, the U.S. Department of State announced that it had issued all available EB-3 and “Other Workers” (EW) immigrant visas for fiscal year 2025 and will not release additional visas in these categories until October 1, 2025

EB-3 and EW Visa Update

The Department of State, in coordination with U.S. Citizenship and Immigration Services, announced that the Employment-Based Third Preference (EB-3) and the EW subcategory have reached their annual numerical limits for FY 2025. INA 203(b)(3) sets the EB-3 visa cap at 28.6% of the worldwide employment-based limit and reserves up to 10,000 of those visas for EW applicants.

As a result, U.S. embassies and consulates will not issue additional visas in these categories until the new fiscal year begins on October 1, 2025. Employers and applicants should plan accordingly and monitor future Visa Bulletin releases for updates on availability.
