E‑Verify Issues New TPS Syria Guidance

  • Following a court‑ordered stay of the TPS Syria termination, E‑Verify has provided revised instructions for employers. 

Temporary Protected Status for Syrian Nationals  

E‑Verify has released updated instructions for employers following the court‑ordered stay of the termination of Temporary Protected Status (TPS) for Syria. 

Background on Temporary Protected Status for Syrian Nationals  

The Department of Homeland Security previously determined that Syria no longer meets the statutory conditions for Temporary Protected Status (TPS), and the designation was scheduled to end on November 21, 2025.  

However, on November 19, 2025, the U.S. District Court for the Southern District of New York issued an order staying the termination in Dahlia Doe v. Noem. As a result, Syrian TPS holders continue to retain TPS and employment authorization while the stay remains in effect. 

Updated Form I‑9 and E‑Verify Instructions 

E‑Verify now directs employers to use the following notations when completing Form I‑9 for employees with TPS‑related Employment Authorization Documents (EADs): 

  • In Section 1, employees should enter “as per court order” in the expiration date field. 
  • In Section 2, employers must enter the expiration date “July 1, 2026” and add a note in the Additional Information box. 
  • When creating a case in E‑Verify, employers should also use July 1, 2026 as the document expiration date.  

Validity of Syrian TPS EADs  

Because of the court order, specific Syrian TPS EADs remain valid for work even if the date printed on the card has already passed. This applies to EADs that originally expired on September 30, 2025; March 31, 2024; September 30, 2022; and March 31, 2021. 

Employers may download and retain the E‑Verify alert and TPS Syria webpages with Form I‑9 documentation.
