DOL Proposes H-2A Rule Changes and Highlights H-2B Filing Deadlines

H-2A Program Rulemaking and Filing Timelines
The Department of Labor’s Office of Foreign Labor Certification (OFLC) has introduced a Notice of Proposed Rulemaking (NPRM) that would rescind provisions from the April 2024 final rule titled Improving Protections for Workers in Temporary Agricultural Employment. The Department of Labor aims to revise how it administers certain labor protections under the H-2A program through the proposed changes.
In addition, OFLC has emphasized key filing deadlines for H-2B applications, particularly the three-day submission window for employers seeking October 1, 2025, start dates. Applicants must submit their materials between July 3 and 5, 2025, and officials will process them using randomized procedures. Submissions outside this window may be denied or delayed.
